I don't understand why the accountants would not fund the trust when Jean O'Connell told them to; I don't understand why the accountants created obstacles to funding the trust and made it appear as if the family were the source of the obstacles.

Note: The final estate account transfers the residual estate assets from the estate to the trust. It automatically closes the estate and funds the trust. The trustee would be in control of the assets transferred to the trust and the accountants would not. The final estate account is the only thing needed from the accountant(s) and the only thing asked for (May 1985: "First thing is to have the final accounting based on same figures as in the 1st accting.  Send it to me- do I have to sign it"). I do not understand why the accountants withheld the final estate account for 14 months and created paper trails of confusion and conflict that make it appear as if the family is the problem.

  • Our dad, H. A. O'Connell, died on May 26, 1975. Does it look as if Joanne Barnes never told our mother, Jean O'Connell, the executor of his Will, or me, the nominated trustee for the testamentary trust in his Will, that a final estate account was required and that I had to qualify as Trustee?

  • The final estate account transfers the residual estate assets from the estate to the trust; automatically closing the estate and funding the trust. Nothing else can do this such as a "deed", "Agreement"or "receipt". The final estate account would transfer the control of these assets from the accountants to the trustee unless the accountants supplant the trustee.

  • Does it look as if Jean O'Connell instructed Joanne Barnes to do the final estate account ("First thing is to have the final accounting based on same figures as in the 1st accting.  Send it to me- do I have to sign it") but Joanne Barnes withheld it for fourteen months? The final estate account is the only thing needed from Joanne Barnes.

  • During these fourteen month does it look as if the accountants led Jean O'Connell to believe that I was the problem and led me to believe that Jean O'Connell was the problem? Did the accountants frame the family?

  • During these fourteen month does it look as if the accountants gained control of Jean O'Connell's future estate and almost the trust under the guise of protecting the family ("If he does not agree or requests further delaying tactics, I feel that I have no other recourse in serving my client than to seek to have him removed as a Trustee. This matter is costing Mrs. O'Connell dearly with the delay.")?

  • Does it look as if the accountants used the family to create false paper trails that made it appear as if the family was the source of the confusion and conflict? ("call- will do draft of final acting. Deed to property-convey to court.  Needs how much")?

  • Does it look as if Joanne Barnes recommended Edward White to Jean O'Connell and Jean O'Connell hired him for the family, but was instructed to not identify him ("She will be working on this soon with a lawyer")?

  • Does it look as if, about 4 months into the withholding of the final estate account, Anthony O'Connell hires an attorney for the family not knowing that there already has been an attorney hired for the family because that attorney is in hiding?

  • Does it then look as if the attoney Anthony O'Connell hired for the family decides that he is only representing Anthony O'Connell, and the attorney Jean O'Connell hired for the family decides that he is only representing Jean O'Connell, and this two attorney structure is used to frame and divide the family under the guise of protecting the family?

  • Does it look as if the attorney hired by Anthony O'Connell for the family, is extremely skilled at using the two attorney structure to make it appear to Anthony O'Connell that the accountant's agenda ("call- will do draft of final acting. Deed to property-convey to court.  Needs how much")? is Jean O'Connell agenda?

  • Does it look as if the attorney hired by Jean O'Connell for the family, uses the two attorney structure to make it appear to Jean O'Connell that Anthony O'Connell is responsible for the accountants withholding the final estate account?

A. O'Connell has to be filed to fund the Trust. The final account transfers the residual estate to the trust and closes out the estate.

Event. These are marital deduction computations by Jesse Wilson.
Situation: Anthony O'Connell was visiting Jean O'Connell and she showed him Robert McCandlish's letter of May 8, 1985. Anthony O'Connell called Robert McCandlish amd made an appointment. As Anthony O'Connell was about to enter Robert McCandlish's office Jesse Wilson stopped him and said that he was supposed to see him and not Robert McCandlish. Anthony O'Connell left with the impression that the source of the problem was somewhere between Jean O'Connell and her accountant. And automatically assuming that accountants can be trusted, are regulated to be so, and that they do what their clients tell them to do, assume that Jean O'Connell must be the primary problem.

Note: History suggests that Jean O'Connell was advised to not give the lawyer's name. Anthony O'Connell is not aware of the accountants advice to Jean O'Connell or of this letter. The accountants have established a policy of secrecy. Secrecy is fatal to the family. It gives the accountants a corridor through the family to plant wedges.
